Before the Disciplinary: Investigation

Before any disciplinary can take place, an investigation must legally have been done. This is where, in our experience, most people slip up. They often tend to use the wrong wording, which can have a detrimental effect further down the road. For example: people frequently use “aggressive” instead of “frustrated.” The wording is key in an investigation. It will be used and not for your benefit!

The disciplinary should be done by someone different to the investigation unless the company is too small to feasibly offer this. The investigation will be to determine whether there is sufficient evidence to proceed, or whether to dismiss the case with no further action.

 

 

 

 

 

 

 

 

Different Types of Disciplinary

Conduct


There are several different types of disciplinary; you can be disciplined for conduct. In this case, the disciplining officer must look at the severity of the allegations and the evidence supporting it. The outcome could either be no further action, a verbal warning, a written warning, a final written warning or – the most severe – dismissal. Performance


Another type of disciplinary is for performance. These would normally result, in the first instance, with a performance plan or more training, with a time scale for improvement. The time frame for this is usually 4-6 weeks, after which a disciplinary will be done and a verbal warning, written warning, final written warning or dismissal can result. The outcome does depend on the result the poor performance is having. For example, if it is legal checks which put the business at risk of closure, this could result in dismissal.
